PEMBROKE PINES - Writ JT Retail Holdings GP, LLC and Pembroke Pines, LP. are being sued for negligence after a trip and fall that occurred on their property.

On October 20, 2014, Judy Provost went to an Office Depot in the complex mentioned above. She legally parked in the handicapped parking spot. She had no problem getting out of her vehicle and walking to Office Depot. However, when she was was finished shopping and returned to her car, she went around to the passenger side and did not realize that the pavement had been uplifted by the roots of a nearby tree. This caused her to trip and fall.

According to the complaint, for several years before the incident, the complex has been directing and/or performing repairs to the parking lot for the same issue. She asserts that this issue was reoccurring and therefore they should have warned her and the invitees of the dangerous condition. Because they failed to do so, they breached their duty to use ordinary care to keep the handicapped space in a reasonably safe condition.

As a result of her fall, she sustained very serious injuries including, but not limited to, mental anguish, pain and suffering, disability, and aggravation of pre-existing medical conditions. 

The Plaintiff now demands judgment against the Defendants for damages in excess of the jurisdictional amount of $15,000 and is represented by Michael Garcia Petit, Esq. of Law Office of Michael Garcia Petit P.A. in Miami Lakes.
