DAVIE -  Woman from Broward County sues another woman for negligent operation of a motor vehicle and for wrongful death damages on behalf of her now deceased mother.

The Plaintiff, Kathryn L. Mulhall-- individually and as a personal representative of the Estate of Olga B. Mulhall, filed a complaint on September 2, 2016 in the 17th Judicial Circuit Court against Diana C. Hothan alleging Diana carelessly and/or recklessly operated or maintained a motor vehicle so that it collided with the Plaintiffs' vehicle.

According to the complaint, on April 6, 2014, the Defendant, Diana, was recklessly and carelessly operating a motor vehicle. By negligently operating the vehicle, she collided with the Plaintiffs Kathryn and her now deceased mother, Olga. On both counts, Diana was found negligent in the aforementioned along with failing to take reasonable precautions, keep a proper lookout, and yield the right of way. Due to this negligence, Kathryn suffered bodily injury including, but not limited to; pain and suffering, mental anguish, and loss of capacity for the enjoyment of life. As a direct, proximate, or contributing cause of the Defendant's negligence, Olga Mulhall died on October 24, 2014.

The Estate of Olga B. Mulhall and her survivor are entitled to damages including but not limited to; loss of companionship and guidance, loss of support services, and loss of net accumulations. The Estate also incurred medical and funeral expenses.

The Plaintiff, Kathryn L. Mulhall as the personal representative of the Estate of Olga B. Mulhall and as the statutory survivor, requests a trial by jury and demands judgment against the Defendant in excess of $15,000.00, pre and post judgment interest as allowable by law, costs, and attorney fees.
